Bad Experience With a Debt Settlement Company?
You’re Not Alone.
The Consumer Financial Protection Bureau (CFPB) has started gathering customer complaints regarding debt settlement. The CFPB protects consumers from abusive practices from for-profit entities that prey on individuals seeking help with student loans, bank accounts, mortgages, and even debt collection. While there are legitimate means of receiving help, there are many for-profit companies that thrive on taking advantage of the financially vulnerable.
In this blog post, we share how you can file a complaint with the CFPB as well as the Better Business Bureau (BBB) to ensure that your terrible experience doesn’t go unnoticed.
When You Should Submit a Complaint
Before we provide you with details on how to start your complaint, it’s best to contact the institution first. You can get started by opening a chat online via their website, sending an email, or making a call. If you do choose to do this over the phone, be sure to make a note of everything you want to say so you don’t forget anything important that they need to hear.
The next part is providing the company the chance to address your complaint; getting a resolution won’t happen overnight but it can be expedited by talking to the right person. If you find that your first call or email hasn’t made a difference, you can try calling again to speak with the manager. This should eventually put you on the right track with someone who will be able to work on and solve your complaint.
Filing a Complaint With the CFPB
If you haven’t gotten anywhere after several calls and emails, or the manager is still unable to provide you with a sound resolution, it’s time to file a complaint with the CFPB. Remember that anyone can file a complaint through this channel; you can file it yourself, or have a lawyer, social worker, housing counselor, or someone else files the complaint for you. You may also have a family member or a trusted friend file a complaint on your behalf.
There are two ways for you to file your complaint; you may call (855) 411-2372 between Mondays and Fridays from 8 AM to 8 PM, or you can file online. To file online, follow these instructions:
-
Open your browser and go to CFPB’s website.
-
Click the “Submit a complaint” button in the upper right-hand corner.
-
Scroll down the page until you see “Start a new complaint” and click it.
-
Tick the box that’s labeled “Money transfer, virtual currency, or money service.”
-
Proceed to scroll down and tick the box labeled “Debt settlement (services for reducing your debt balance on things like credit cards or medical debt).”
-
Click Next at the bottom of the page and tick the box that explains the kind of problem you have with the CFPB. You will be able to provide more details at a later step.
-
Choose “Yes” or “No” to answer whether you have already tried contacting the company directly to fix the problems you have.
-
Click the “Next” button.
-
Write detailed answers to the questions asked by the Bureau regarding what happened and what went wrong with your experience through the company.
-
Be sure to add documents that can support your claims such as a copy of the contract you signed, emails or letters the company gave you, as well as letters you sent them.
-
When you’re done, click “Next” at the bottom of the page.
-
Provide the name of the company you wish to file a complaint against. A list of company names may come up on the screen, simply click on the right one. If it’s not there, click the “Next” button.
-
If the company’s address isn’t available on the CFPB, they will ask you to provide it.
-
The website will also ask you who was involved, which could be you, someone else, or you and someone else.
-
Be sure to click the right box to get started on a set of follow-up questions.
-
Answer each question and provide the right contact information.
-
Click on the last button at the bottom of the page to review your complaint.
Filing a Complaint With the BBB
In cases where an illicit business has deceived a victim into paying for their debt without the intention to deliver on their promises, time is of the essence. Apart from filing a complaint with the CFPB, you can also file a complaint with the Better Business Bureau (BBB). Each year, they help customers settle a wide range of disputes, including:
-
Customer service
-
Contracts
-
Sales
-
Debt settlements
-
Warranties
-
Refunds
-
Billings
The BBB also accepts complaints against companies that aren’t on their list. As such, they provide victims with more reach and a bigger possibility of having their dispute resolved. To start your complaint, be sure to follow these steps:
-
Visit their website.
-
Go to the search bar and look for the company’s name; be sure to add the location where you did business if they serve nationwide.
-
Click on the company you wish to file a complaint against.
-
Click on the link labeled “File a Complaint.”
-
Choose from one of the three options:
“File a complaint”
“File a review”
“File a scam report”
-
Start your complaint.
How You Can Get Your Money Back from a Settlement Company
If you’ve been duped out of your hard-earned money by a dishonest, or poor-performing debt settlement company, you’ll need to act fast. Filing a complaint with the BBB will allow them to resolve the case which may result in a refund, but they won’t be able to force the company to give back your money.
There are a few other places where you can report a problem that might or might not result in getting your money back. The same can be said about the CFPB; while they work to provide consumer protection, they won’t always be able to guarantee a refund once a dispute is settled.
Conclusion
While both the CFPB and the BBB can help you settle your disputes with debt settlement companies and provide consumer protection to some extent, they don’t work as a deterrent from fake companies. It’s up to you to do your due diligence and research companies before doing any kind of transaction with them.
